Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Speaker Cleaner application ("the app") and the website at speakercleaner-app.com (together, "the Service"), provided by Ivan Denisov, FOP (sole proprietor), registered at pas. 5th Kyivskyi, Korop, Chernihiv region 16200, Ukraine (VAT: 3442816551) ("we", "us", "our"). By downloading, installing, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Speaker Cleaner is a utility that generates calibrated sound tones intended to help dislodge water, dust and debris from device speakers, and to test audio output. The website provides a free, browser-based version of the cleaning tool together with informational guides. The Service is a maintenance aid only and is not a diagnostic, medical or professional repair service.
2. Eligibility
You must be at least 13 years old (or 16 in the EU/EEA) to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer or attempt to extract the source code of the app or website, except to the extent such restriction is prohibited by law.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Interfere with, disrupt, or attempt to gain unauthorised access to the Service or its related systems;
- Use the Service in a way that could damage, disable or impair it, or harm other users;
- Reproduce, resell or commercially exploit any part of the Service without our prior written consent.
5. Subscriptions and payments
Some features require a paid subscription or one-time purchase ("Premium"). All purchases are processed by Apple through the App Store and are subject to Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID settings. Refunds are handled by Apple via reportaproblem.apple.com; we do not process payments or issue refunds directly.
6. Safety disclaimer
The Service produces sound at high volume to dislodge water and debris. You use it at your own risk. Specifically:
- Hearing: prolonged exposure to loud tones can damage hearing. Always remove headphones, AirPods or in-ear devices before running a cleaning cycle through them, and keep volume at a comfortable level.
- Device: while the tones are calibrated to be safe for standard speakers under normal conditions, we cannot guarantee results for every device or situation. The Service is not a substitute for professional repair of liquid-damaged or faulty hardware.
7. No warranty
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or effective in removing water or debris from any particular device.
8. Limitation of liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, devices, hearing, profits or goodwill, arising out of or in connection with your use of, or inability to use, the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
9. Intellectual property
All rights, title and interest in and to the Service — including the software, design, text, graphics and the Speaker Cleaner name and logo — are owned by us or our licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
10. Third-party services
The Service relies on third parties including Apple (App Store, payments, analytics) and RevenueCat (subscription management). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of third parties.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we handle data. By using the Service you consent to the data practices described there.
12. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that could cause harm. Provisions that by their nature should survive termination (including disclaimers, limitations of liability and intellectual-property terms) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "last updated" date above. If the changes are material, we will provide reasonable notice through the app or website. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. Mandatory consumer-protection rights available to you in your country of residence are not affected by this provision.
